NEMA

National Environmental Management Act (NEMA) is a progressive environmental management legislation in South Africa and globally. It has provided the framework for decision-making for individuals, institutions, and government.

National Environmental Management Act 
Act No. 107, 1998

"To provide for co-operative environmental governance by establishing principles for decision-making on matters affecting the environment, institutions that will promote co-operative governance and procedures for co-ordinating environmental functions exercised by organs of state; and to provide for matters connected therewith."

The NEMA defines the environment as the surroundings in which humans exist and includes the land, water and atmosphere. In addition, it includes the interrelationships, combinations, properties and conditions of all organisms that exist within the surroundings. This extremely broad definition of the environment ties into the concept of integrated environmental management, which the NEMA promotes. The NEMA is not able to specify how each component of the environment is legislated, as such, a significant amount of environmental legislation stems from the NEMA

 "The purpose of this Notice is to identify activities that would require environmental authorisations prior to commencement of that activity and to identify competent authorities in terms of sections 24(2) and 24D of the Act."  "The purpose of this Notice is to identify activities that would require an environmental authorisation prior to the commencement of that activity and to identify competent authorities in terms of section 24(2) and 24D of this Act."

 Amendment of EIA Listing Notice 3 of 2014   
"The purpose of this Notice is to list activities and identify competent authorities under sections 24(2), 24(5) and 24D of the Act, where environmental authorisation is required prior to commencement of that activity in specific identified geographical areas only."

Regulations

Regulations relating to the procedure to be followed when Oral Requests are made in terms of Section 30A
10 April 2015

"The competent authority may direct a person to carry out a listed or specified activity, without obtaining an environmental authorisation to prevent or contain an emergency situation or to mitigate the effects of the emergency situation."
